DOJ ready to arrest Dela Rosa if he tries to leave the country
Despite a pending petition before the Supreme Court for legal remedies on his arrest warrant from the International Criminal Court (ICC), Justice Secretary Fredderick Vida ordered the arrest of Senator Ronald Dela Rosa if he attempts to leave the country.
"The DOJ (Department of Justice) will treat any attempt of Senator Dela Rosa to leave the country as a mockery of justice and I am giving specific orders to law enforcement agencies or border control authorities that if Sen. Bato Dela Rosa will try to leave the country, appropriate arrest should be made," Vida told reporters during a press conference on Friday.
Dela Rosa left the Senate, which took custody of him last Monday, on Thursday after a shooting incident inside the Upper Chamber. He was said to have been driven out of the building by another senator.
As he confirmed the validity of the warrant of arrest issued by the International Criminal Court (ICC) against Dela Rosa, Vida emphasized that the agency is waiting for the decision by the Supreme Court (SC) on the petition of Dela Rosa seeking a temporary restraining order (TRO) of his arrest warrant.
Vida said government lawyers will submit their reply to the SC on Saturday on Dela Rosa's petition. The senator was earlier given 72 hours since Thursday to present his petition. The SC is expected to reply next week.
The ICC alleges that Dela Rosa played a key role in the war on drugs where many were killed during his time as Davao City police chief and head of the national police agency.
"On the arrest warrant issued by the ICC against Senator Ronald Dela Rosa, with this press briefing I do confirm that there is a valid ICC arrest warrant and a pending request from the ICC to serve the same has been duly received by the Philippines," he said.
"He (Dela Rosa) is under the protective custody of the Senate and we expect the appropriate turned over once all the legal issues have been resolved the petition pending before the Supreme Court, off course we do acknowledge the judiciary the SC being the final arbiter of resolving all these issues that is why I just met with the lawyers of the office of the Solicitor General," he added.
Since returning to the Senate on Monday after being absent for five months, an arrest warrant allegedly from the ICC was tried to be served by the National Bureau of Investigation on Dela Rosa. He evaded the agents, sprinted to the plenary where the new Senate President Alan Peter Cayetano put him under protection of the Upper Chamber.
But a few hours after a shooting incident inside the Senate on Wednesday, Dela Rosa left the Senate.
Vida also announced that an investigation of the incidents that occurred within the Senate premises this week is ongoing.
"At this time the investigation is ongoing, we assure the public that a complete, transparent and partial investigation will be conducted," he said
"The deadline was given for the initial report by the law enforcement agencies particularly the NBI, PNP (Philippine National Police), SPD (Southern Police District), NCRPO (National Capital Region Police Office) to submit the report no later than 5pm Wednesday next week and also this is a similar request to the office of OSAA (Office of the Senate Sergeant at Arms)," he added.
